Music is not music to all

To nonmusicians, music is just noise.

Seems to me that one should have the right to have some kind of live music in one's own apartment once a week, ending at some reasonable hour. You should discuss this with whomever tacked that note on your door. If the note is anonymous, then leave your own note requesting that he/she reveal identity so that the two of you could hash this out in some rational manner. Until that person is willing to come forward and discuss this matter with you, you should continue with your ensemble playing.

Nonsense. Just because someone's not a musician doesn't mean music is just noise to them, otherwise only musicians would buy cds or go to shows. And just because someone is a musician doesn't mean they won't be annoyed if they're trying to read/study/watch a movie/sleep/etc and other people are playing loud music that's bleeding through the walls. As musicians, our right to enjoy our music does not extend to the point where it infringes upon someone else's right to enjoy their own life in their own home.

Now, forbidding us from playing music in the park or anywhere else far away from residences and businesses, that's a different story. That's just wrong. It's unconstitutional, it is!

OK, let me put it another way. To someone else who has no interest in your music, your music is just noise.

Well as the story is unfolding, the resident owner of the next door property got some new
tenants, and they are really complaining, they call themselves victims.

My session was only on thursdays and always ended before 9:00 p.m. I never practiced
after 9:00 as well. The session did have up to 6 players though :wink:

Anyways according to San Francisco article 29, which concerns noise, I have the right to make noise
up to 5 decibels higher than the ambient street noise as measured at their property line at a height of
4' or so.................yeah, right!

As it goes they are even objecting to me practicing now :cry:

So as the woman I live with really hates to rock the boat, I guess it's time to start looking for a new
place.

Maybe one of those live / work warehouses or something.............

Good luck my friend... You know working it out with someone doesn't mean "making waves".
Have you talked with them yet?
If you have, then I guess you know how they feel and it's a done deal.. But if not, maybe they'll end up being OK with a compromise. I got in good with the lady and her husband above me. Offered to do some stuff for them, and made a point to stop and pet their dog when they walk her - smile and the regular schmoozy stuff.. When it came to us playing, I'd let her know ahead of time a day or two before (that was our compromise), and asked her if it was OK before I had the boys over (not part of our compromise, but just thought it'd be nice in case she was doing something that day that she wanted it quiet for). No open window, no bombas, daylight hours, and no complaints.
But, people can be entrenched and irrational, so all the best with the neighboring episode....
And btw, we're renting a local place nearby for when we get the whole group together in the winter months.. It's 12 bucks an hour

Let us know how it comes out!

Just to add to this episode.
It didn't work out with the spot we rented because the new-age guy that we rented it from had a new-age wife that wanted us to take off our shoes every time we entered, including the load in and load out. No beer, etc.. So due to their "persnikityness" and the fact that our group is filled with bearded hairy mud slinging, heavy boot wearing, smoking, beer spilling slovenly Neanderthals, we had to let that one go.

So, we had a few sessions at my place.. I warned the neighbors and went through proper protocol which we had established, but in the end, it was too much for the woman upstairs.. She's fine with this Saturday because she's doing something away from home - for freaking once - but her request is that we have the band at my condo no more than once a month. I fully understand,, we make an enormous amount of sound, and our floors must be only microns thick.
Actually, I'm glad she made it clear, and it really isn't a problem. I'm going to try to get hold of our property management and put down the deposit and get the key to our complex's clubhouse. It's not much bigger than my place, and we'll have to bag up any trash, and maybe vacuum it when we leave, but if it's available, the deposit is just a token legality and you get it back no cost when you return the key.
If not, then we go to Eric's "dirty-man" trailer.. :shock:

Hey Dave,
Oh the woes of playing the drums. I haven't moved yet, but it's on the schedule. My situation
escalated a bit, even though I cut way back the neighbor insists that I stop and took to calling
me "the monkey on the drums" at the top of his voice in the street.
So I wrote him a letter telling him I was feeling threatened by his behavior and I wasn't doing anything wrong,
and told him never to contact me again.
He wrote a letter saying he would complain directly to the police, which makes me happy actually.
Anyways due to my current unemployed situation I am now practicing for 2-3 hours between 11-4 or so, I keep
it down. If the cops show it's fine with me I know my rights and know the city code regarding noise very well.
I think that clubhouse is a great idea for you Dave, I wish I had one. If you want any home improvement designs
for your condo regarding noise I can help you out, it's a subject I've been researching.

I know how you feel. I feel your pain. I now hide in my bedroom with a towel on my quinto so my wife and kids don't fuss. :shock: Here and there I remove the towel and :twisted: :mrgreen:
